Each use of this site takes place only with registered user who has:

- Required registration to the site as stated in this document.

ARTICLE 1 - PURPOSE AND DEFINITIONS
The www.hbushop.it portal aims to sell DIY and DIY products on the internet through the www.hbushop.it portal; it is therefore necessary to specify better the terms that will be used in these General Terms of Sale to facilitate the user in understanding the text.
"Visitor": is the one who browses inside the portal without having made any registration, without having created any Account, without ever having purchased on the portal;
"Registered User" / "User": is the one who created an Account on the portal, therefore owns his own User Name and Password but never purchased;
ARTICLE 2 - REGISTRATION TO THE SITE AND ACCEPTANCE OF THE GENERAL TERMS OF SALE
The visitor who intends to purchase one or more products on the www.hbushop.it portal will first have to register to create an area dedicated to him. Registration is free. The visitor is therefore required to complete the required fields (first name, last name, full billing address, any delivery address if different from the billing address, telephone number) with their "password" and "email address" by entering real and correct data in order to proceed with the delivery of the goods and entering active and functioning e-mail addresses in order to receive communications related to their orders from the company www.hbushop.it.
The user is required to copy and paste the code present in the account activation email in order to finalize and authenticate the subscription and then to be able to make purchases. www.hbushop.it will send an email confirming the registration to the specified e-mail address. At any time, the user can edit their data directly from their control panel.
The user ensures that the registration credentials provided during the site registration process are complete, correct, and truthful. The user is guaranteed the secrecy of their access data to the reserved area to avoid the embezzlement of other people by the sensitive. You undertake to inform customer service directly if you suspect, or become aware of, undue use or undue disclosure of your personal data. By accepting the General Terms of Sale and Use, you also accept the fact that, if you use the services offered illegally (massive or too frequent purchase, do not withdraw products purchased more than 2 times in a row), www.hbushop.it may deactivate the account and reject or delete orders from: (i)from users with whom you have a legal dispute, (ii) by users who have violated these General Terms of Use and General Terms of Sale, (iii) by users who have been involved in fraud of any kind and, in particular, to credit card payment fraud(iv) by users who have released false, incomplete or otherwise inaccurate identification data.
Reserving to inform the relevant authorities in case of any criminal and/or civil liability.

ITEM 3 - PURCHASE ORDER, CONTRACT CONCLUSION, ORDER STATUS, PROPERTY RESERVE
After the free registration to the site, the telematics system composes the order in relation to the choices made by the registered user, details the ordered items, indicates in clear the price of the items and any discounts on the price of the same, details the cost of the shipment and the way of payment of the goods. A notification will be sent via email confirming the order containing the summary of the order (price per product, quantity, payment method, delivery fees, order date, link to sales and usage terms). The customer is informed and takes a look at the order that is transmitted to their e-mail address.
The contract must be concluded at the time of the transmission of the order by the user to www.hbushop.it, after verification of the payment and correctness of the order data. If there is the unavailability of a product for reasons not directly related to the service offered by www.hbushop.it., it will be the care of the staff to propose a product of the same characteristics.
When the goods are delivered to the courier, the courier will contact the customer for delivery.
The customer will be able to download the accounting documents (Invoice Copies) by entering their account. The invoice validates the product guarantee and allows the customer in any situation to have a valid tax document in hand under the terms of the law. The information provided by the user at the time of the transmission of the order through the site is true for the issuance of the invoice, which the user guarantees to be true. No change in invoice will be possible after the issuance of the invoice. You are committed to keeping www.hbushop.it undead and www.hbushop.it any damage to it, including any penalties, in the event that the data provided by the user through the invoice issuance site is not true.
The system guarantees a personal archive that can be used by customers to view orders placed in the past containing the relevant invoices. In case the invoice is not available in your account, you can always request it by contacting customer servicedirectly.
Ownership of the products will be transferred to the user at the time of receipt, to be understood as the time of withdrawal of the Product. The risk of loss or damage of products, due to reasons not attributable to www.hbushop.it, on the other hand, will be transferred to the user when the user or a third party he or his designated, other than the carrier, enters materially in the possession of the Products.
In any case, www.hbushop.it reserves the right of ownership on the Products until the full amount owed is paid.
ARTICLE 4 - PRODUCT PRESENTATION AND PRICES
The datasheets and details of each Product on the site are written directly by our suppliers, therefore, www.hbushop.it disclaims any responsibility for any errors and/or inaccuracies and/or defects of correspondence between the descriptions and the real product. The photos entered for each Product are indicative and non-contractual, so they may not match by color, size or accessories.
The images of the Products on the site are original photographs to be understood as indicative and for example. Photographs, texts, PDFs, graphics, information and features reproduced and illustrating the products are not contractual.
www.hbushop.it may not be held liable, if applicable, in the event of an error or omission in any of these photos, texts, graphics, information or product characteristics, or if suppliers change product characteristics. The prices of the products published on our website are in EURO and do not include shipping costs. The amount of shipping costs will always be indicated in the purchase order and calculated by the system in relation to the weight and size of the product, without distinctions related to the place of delivery in the Italian territory.
The prices of items visible on the site may vary periodically depending on the adjustment of the price lists of our suppliers and/or material errors in the entry/typing.
The products will be invoiced according to the rates in force at the time of confirmation of the orders.
The proposed products comply with existing Italian legislation and the rules applicable in Italy and Europe.
www.hbushop.it reserves the right to withdraw any product from the website at any time and/or remove or publish any type of material and/or content. It also reserves the right to modify and/or remove any form of promotion. It is known that the offers posted on the site have limited time duration and with limited quantity of products.
ARTICLE 5 - PRODUCT INVENTORY
In each product sheet you can view the availability of the Product according to the following terminology: "Available": the Product, at the time it is displayed, is available in our warehouses.
If the product is no longer available due to unavailability, www.hbushop.it will notify you by email and this will be legitimate to terminate the contract immediately. If the payment has already been made, www.hbushop.it will refund the amount paid by you and any other expenses incurred during the fulfillment of the order as soon as possible. The termination of the purchase agreement under this paragraph involves the termination of the credit agreement, if any.
ARTICLE 6 - PACKAGING AND PACKAGING
The goods are checked and packaged in a suitable casing in order to ensure a perfect and integrated delivery. Bulky and/or heavy goods are placed on wooden pallets to reduce the risk of transport disruptions.
In any case, the goods depart from www.hbushop.it warehouses, or from contracted warehouses, in excellent condition, integrated and controlled.
Users are informed that the courier may also cause damage to the contents of the package or packages. It is mandatory to check the status of the envelope when accepting the goods and in particular:
- that the package is intact, not damaged and wet and in any case conforms to the standard characteristics of an ordinary package;
- that the number of packages (number of packages) indicated on the transport slip and in the e-mail summary of the contents of the order is corresponding to the number of packages actually delivered.
Any objections should be immediately raised to the carrier, in the absence of these, the product is considered delivered intact properly. If in doubt and to ensure a fast and efficient after-sales service, please accept the package by signing "with specific reservation" specifying the reasons. Without a written reservation, it will not be possible to retaliate for damage to the goods.
www.hbushop.it denies any responsibility for theft, shortfalls, ruptures or damage. Users who will accept the goods without reporting any issues at the time of delivery will not be able to take advantage of the replacement, repair or compensation as www.hbushop.it cannot be held responsible for transport.
ARTICLE 7 – DELIVERY
www.hbushop.it delivers the products exclusively on the Italian territory through trusted couriers.
The average delivery time is between 2 and 4 working days, excluding weekends, holidays (excluding islands, poor resorts and products to order). The delivery times indicated are merely indicative and non-binding, not depending on the will to www.hbushop.it, the same will also be indicated in the purchase order, as well as on the product sheet.
www.hbushop.it may not be held in any way responsible for any delays due to third-party events and/or causes of force over.
The delivery obligation is intended to be fulfilled by transferring material availability or, in any case, to the control of products by the user.
Delivery is only made on a street floor, no deliveries are made by appointment.
The user acknowledges that the withdrawal of the Product is its precise obligation and takes place at its sole charge.
The customer at the time of the order undertakes to enter a correct postal address and/or check for any errors before confirming the order. Any impediments and/or special conditions related to the access routes to the delivery address must be indicated by the customer in the purchase order by means of a special email written to customer service.
The user receives an email from www.hbushop.it when the goods have been packaged and ready to be picked up by the courier. The courier sends a text or email to allow you to follow the shipment. Each user can follow the shipment by accessing their reserved area in "view your orders" - track the package. Some of our products are shipped directly from the warehouses of our suppliers who do not use Bartolini and do not give tracking number in order to follow the shipment.
ARTICLE 8 - RIGHT OF WITHDRAWAL
Under Article 52 of the Consumer Code, the customer has the right to withdraw from the contract within 14 business days from the date of receipt of the goods, if not specifically stated. In the case of separate delivery of multiple products ordered by the customer and part of a single purchase order, the right of withdrawal can be exercised within the fourteenth day after the last ordered product is received.
In accordance with the current legislation, the withdrawal may be carried out by recommended receipt notice at the headquarters of www.hbushop.it as indicated in the preface, or by equinolent means (example: PEC). The withdrawal can be anticipated using the appropriate form, sending the same also by e-mail to the e-mail address: info@hbushop.it.
In the event of the correct exercise of the right of withdrawal we will refund what is owed within 14 calendar days from the time we have received the notice and after viewing the asset. The refund will be made by the same form of payment chosen by the customer during the order confirmation process.
www.hbushop.it disclaims any liability for any delays in credit, which depend on the bank, the type of credit card or another payment method used.
The cost, manner and responsibilities for the return of the goods are borne by the customer.

The withdrawal does not entitle you to the full refund of the price if the Product is not returned substantially intact, such as, for example, in the following cases:- lack of the original packaging (it is therefore advisable to keep the original packaging of the product at least until the deadline for the exercise of the withdrawal);- absence of integral elements of the product (accessories, cables, shelves, screws, instruction manuals etc);- products manipulated after delivery;- furniture delivered disassembled but also partially mounted by the customer;- damage.
For example, but not exhaustively under Article 55 of the Consumer Code (DLGS 206/2005), the right will not be exercised in the event of:
- Custom-packaged goods;
- Clearly personalized goods;
- Assets that cannot be sent back or that are likely to deteriorate or change rapidly.
The shipment, until the receipt of the goods in our warehouse, is the responsibility of the customer.
www.hbushop.it may suspend the refund until the products are received or until the user has demonstrated that they have sent the products back.
Please note: if the withdrawal has not been exercised in accordance with applicable law, it will not result in the termination of the contract and, consequently, will not qualify for any refund.
www.hbushop.itne will notify you, by e-mail, within 5 business days of receiving the product, rejecting the request for withdrawal. The product will remain at the www.hbushop.it available to you for collection, which must be done at the expense and under the responsibility of the user. The above does not apply to a Professional Customer as it does not enjoy the prerogatives provided by the Consumer Code.
For open and non-functioning or defective goods, the product must be directed to service centers. In the tab of each individual product you will find the link that refers directly to the contacts of the service centers.
The www.hbushop.it stores in the country will not be able to accept returns of products purchased on the Site.
ARTICLE 9 - PAYMENT METHODS
The portal uses the secure payment service Credit Cards: (Visa, Mastercard, Postepay) our payment page is a secure payment page in encrypted https format.
We rely on VeriSign Secured certified banking companies // Verified Visa // Secure Mastercard. To proceed with purchasing one or more products with a credit card, select the type of credit card you want to use to make the purchase and follow the instructions.
Paypal: to shop online only by entering your email address and password without entering your card number or other personal information. Click on the Paypal symbol, the user will be redirected to the Paypal portal page, will make the payment of the products according to the procedure provided and governed by PayPal and the terms and conditions of the contract agreed by the user with Paypal. In the case of payment through Paypal, the amount due will be charged by Paypal to the user at the same time as the conclusion of the online contract. In the event of a termination of the purchase agreement and in any other refund case, in any respect, the refund amount will be credited to your Paypal account. The timing of re-accreditation depends solely on Paypal and the banking system, www.hbushop.it cannot therefore be held liable for any omissions. You must contact Paypal directly for any objections.

www.hbushop.it is not liable in the event of damages, of any nature, arising from the installation and/or use of the product improperly and/or not in accordance with the instructions provided by the manufacturer, as well as in the case of damage resulting from chance or force majeure.
ARTICLE 12 LEGAL GUARANTEE OF COMPLIANCE
All products purchased on the www.hbushop.it portal have a legal guarantee of compliance under current EU and national law. Consumers can particularly enjoy the guarantee provided within the consumer code (DLGS 206/2005) as provided by Articles 128-135 under Title III – LEGAL GARANZIA OF CONFORMITY AND COMMERCIAL GARANZIES FOR THE CONSUMPTION PRODUCTS referred to.
In Italian law we refer to the Consumer, as the one who buys and uses an asset for personal purposes, and to the Professional, as the one who buys products for the purpose of using them for a professional activity.
The rights for each individual subject and how to enjoy these guarantees are best explained below.
Consumer Guarantees.
The seller is liable to the consumer for any compliance defects that existed at the time of delivery of the asset. The compliance defect must be reported to the seller at the penalty of termination of the guarantee, within two months of the date on which it was discovered. In the event of a compliance defect, the consumer is entitled to the restoration, without charge, of the compliance of the asset by repair or replacement, that is, to an adequate reduction in the price or the termination of the contract, as provided for by Article 130 C.Consumption.
The consumer may, at his or her choice, ask the seller to repair the property or replace it at no cost in both cases, unless the required remedy is objectively impossible or excessively burdensome compared to the other.
Unless proven otherwise, compliance defects are assumed to occur within six months of delivery of the product already existed at that date, unless that hypothesis is incompatible with the nature of the product or the nature of the defect.
For the purposes of the exercise of the legal guarantee right, you must provide proof of the date of purchase and delivery of the asset. It is therefore recommended that you always keep the purchase receipt/invoice, as well as the documents of the shipment and delivery of the product.
Products repaired, modified or altered by the user are excluded from the legal guarantee, and any faults or malfunctions or other defects caused by accidental events or user liability or non-compliant use of the product are also excluded.
In the event of a termination of the contract, www.hbushop.it commits to the return of the price paid in addition to shipping costs and any additional costs. In the event of a price reduction, this will be agreed before time between the parties and then www.hbushop.it will return the expected amount according to the forms and manners agreed.

Guarantees for the Professional Customer.
The trader will only be eligible for the guarantee for vices of the thing sold under the terms and for the effects of Article 1495 and the following of the Civil Code.
